The Trustee for Hey Bear Trading Unit Trust (ABN 92 604 495 435), trading as HeyBear (“HeyBear”, “we”, “us”, “our”), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose and protect personal information, including when you visit itsheybear.com, buy our products, contact us, or enter a HeyBear promotion or competition (such as “Scan To Japan”).

This Policy is written to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By using our website, purchasing our products, or entering a promotion, you agree to the collection and use of your information as described here.

1. Who we are

HeyBear is a better-for-you confectionery brand. Our products are sold online at itsheybear.com and through retail partners in Australia. The entity responsible for your personal information is The Trustee for Hey Bear Trading Unit Trust (ABN 92 604 495 435), of U3 63 WILLOW AVE, SPRINGVALE, VIC, 3171.

2. Personal information we collect

The information we collect depends on how you interact with us:

  • Contact details — name, email address, delivery address, phone number (if provided at checkout).

  • Order and purchase information — items purchased, order value, order history, and payment confirmation (payment card details are processed and stored by our payment provider, not by HeyBear).

  • Promotion entry information — for competitions such as Scan To Japan: your email address, a photograph of your purchase receipt, and your State or Territory of residence; for prize winners, your full name and delivery address.

  • Communications — anything you send us via email, social media, or contact forms.

  • Technical information — IP address, browser type, device information and site usage data, collected automatically via cookies and similar technologies.

3. How we collect personal information

  • Directly from you — when you create an account, place an order, subscribe to marketing emails, contact us, or enter a promotion.

  • Automatically — through cookies and analytics tools when you browse itsheybear.com.

  • From service providers acting on our behalf — for example, our promotion platform provider when you enter a competition (see section 5).

4. Why we collect and use personal information

  • To process and deliver your orders.

  • To operate our website and provide customer support.

  • To run promotions and competitions, verify entries, select and notify winners, and deliver prizes.

  • To send you marketing communications, where you have opted in (see section 6).

  • To improve our products, website and marketing, including through aggregated or de-identified analysis.

  • To comply with our legal obligations, including tax, consumer law and trade promotion record-keeping requirements.

5. Promotions and competitions

When you enter a HeyBear promotion (such as Scan To Japan), your entry is subject to that promotion’s specific Terms and Conditions as well as this Privacy Policy.

Our promotions are run using the Easypromos platform, provided by Easypromos SL, which acts as our data processor for entry, gameplay and prize-draw data. Easypromos is GDPR and ISO 27001 compliant. Easypromos processes entrant data solely on our instructions and does not use it for its own purposes. The random prize draw used in our promotions is conducted using Easypromos’s certified Random Number Generator, independently tested and certified against the international GLI-19 v3.0 standard.

Prize winners’ first initial, surname and State will be published as described in the relevant promotion’s Terms and Conditions. We keep promotion entry records for as long as required by applicable trade promotion and record-keeping laws.

6. Marketing communications

If you opt in, we may use your email address to send you marketing communications about HeyBear products, offers and promotions. Opting in is optional and is never a condition of purchasing a product or entering a promotion. You can unsubscribe at any time using the link in any marketing email, or by contacting us using the details in section 10.

We use a third-party email marketing platform to manage and send these communications on our behalf.

7. Who we share personal information with

We do not sell personal information. We share it only where necessary to operate our business, including with:

  • Our e-commerce platform provider, to process and fulfil orders.

  • Our payment processor, to process payments securely.

  • Our delivery and logistics partners, to deliver orders and prizes.

  • Our email marketing platform provider, to send communications you’ve opted into.

  • Our promotion platform provider, Easypromos SL, for the purposes described in section 5.

  • Our advertising and analytics partners, to measure and improve our marketing (using aggregated or pseudonymised data where possible).

  • Government or regulatory bodies, where required by law.

We require our service providers to protect your information and to use it only for the purposes we’ve authorised.

8. Overseas disclosure

Some of our service providers, including Easypromos, store or process data outside Australia (Easypromos is EU-based). Where personal information is disclosed overseas, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.

9. Data security

We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. No method of transmission or storage is completely secure, but we work with reputable service providers who maintain appropriate security standards.

If you’re not satisfied with our response, you have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

Our website uses cookies and similar technologies to operate the site, remember your preferences, and understand how visitors use itsheybear.com, including for advertising and analytics purposes. Our website, products and promotions are directed at adults. We do not knowingly collect personal information from children. Promotion entry is restricted to entrants aged 18 or over, as set out in the relevant promotion’s Terms and Conditions.
